本規約は、個人開発者（以下「当方」）が提供するアプリケーション「PickFace（顔図鑑）」（以下「本アプリ」）の利用に関し、当方とユーザーとの間の一切の関係に適用されます。
本アプリは、ユーザーが選択したグループ写真から人物の顔を検出・切り抜き、かわいい「顔図鑑」コラージュを作成する機能、および端末内の写真ライブラリから選んだ人物が写っている写真を検索する機能を提供します。これらの処理はすべて端末内（オンデバイス）で完結し、ネットワークへの写真送信は行われません。
本アプリは基本無料で利用でき、広告表示および利用回数制限があります。広告非表示・利用制限解除のための買い切り型アプリ内課金を提供しています。価格は Apple App Store の本アプリのストアページに表示されるものが正式な価格となります。購入、支払、返金については、Apple App Store の規約およびポリシーが適用されます。当方は原則として直接の返金を行いません。
本アプリのUI、コード、デザイン、商標その他一切のコンテンツに関する著作権および知的財産権は、当方または正当な権利者に帰属します。ユーザーは私的利用の範囲でのみ本アプリを利用できる、限定的かつ譲渡不能なライセンスを付与されます。ユーザーが本アプリを用いて作成した顔図鑑（コラージュ画像）自体の利用は、ユーザー自身の写真素材に対する権利の範囲内でユーザーの責任において行うものとします。
ユーザーは以下の行為を行ってはなりません。
本アプリの顔検出・人物検索機能は、Apple の Vision フレームワークおよびオンデバイス機械学習モデルを利用した自動処理であり、常に正確な結果を保証するものではありません。写真の画質、角度、照明、遮蔽物等により、顔の検出漏れ、誤検出、人物の取り違えが発生する可能性があります。
本アプリは医療、法執行、身元確認、認証（ロック解除等のセキュリティ用途）を目的としたものではなく、これらの用途への使用は想定されていません。重要な判断（本人確認等）を本アプリの結果のみに依拠して行わないでください。
ユーザーが本アプリで処理する写真に第三者の顔が写っている場合、当該写真の利用・保管・共有について、適用されるプライバシー関連法令（肖像権を含む）を遵守する責任はユーザー自身にあります。当方は、ユーザーが選択した写真の内容について一切関与せず、責任を負いません。
当方は、本アプリの利用により生じた直接的・間接的・付随的・結果的損害について、当方に故意または重過失がある場合を除き、一切の責任を負いません。ただし、法令により免責が認められない範囲ではこの限りではなく、当方の責任は適用法が認める最大限度において制限されます。消費者契約法その他の強行法規に基づきユーザーに認められる権利は本条により制限されません。
本アプリは「現状有姿」で提供され、商品性、特定目的適合性、非侵害性、検出精度等について明示または黙示の保証を行いません。
当方は事前通知の有無にかかわらず、本アプリの内容の変更、更新、配信停止を行うことができます。
当方は本規約を改定することがあります。重要な変更はアプリ内またはストアページで通知します。改定後に本アプリを継続利用した場合、変更に同意したものとみなします。
EU／英国居住の消費者に対しては、消費者保護に関する強行法規（指令2011/83/EU等）が本規約に優先して適用されます。
本規約は日本法を準拠法とし、本アプリに関する一切の紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。ただし、ユーザーの居住国の消費者保護法が強行的に適用される場合はこの限りではありません。

These Terms govern your use of the mobile application "PickFace" (the "App") provided by an individual developer ("we", "us").
The App detects and crops faces from a group photo you select, arranges them into a cute "face album" collage, and can search your device's photo library for photos containing a chosen person. All of this processing is performed entirely on your device; no photos are transmitted over the network.
The App is free to use with advertising and usage limits. A one-time in-app purchase is offered to remove ads and unlock usage limits. The price shown on the App's listing page on the Apple App Store is the authoritative price. Purchases, billing, and refunds are governed by the terms and policies of the Apple App Store. We do not process refunds directly.
All copyrights, trademarks, design, code, and UI of the App belong to us or our licensors. You are granted a limited, non-transferable, revocable license to use the App for personal, non-commercial purposes. Any face album (collage) you create using the App is your own creation from your own photo materials, and your use of it is subject to your own rights in the underlying images and your own responsibility.
You must not: (a) reverse engineer, decompile, or disassemble the App, including extraction of any on-device model; (b) reproduce, redistribute, lease, or sell the App; (c) use the App with photos of third parties without their consent for purposes of impersonation, harassment, defamation, stalking, or any other infringement of another person's rights; (d) violate applicable laws; or (e) interfere with the App's functionality.
The App's face-detection and person-search features rely on automated on-device processing using Apple's Vision framework and on-device machine-learning models, and do not guarantee accurate results at all times. Depending on photo quality, angle, lighting, and occlusion, the App may fail to detect faces, produce false detections, or confuse one person with another.
The App is not intended for medical, law-enforcement, identity-verification, or authentication purposes (such as unlocking devices or accounts) and should not be used for such purposes. Do not rely solely on the App's output for any decision requiring confirmed identification of a person.
If a photo you process in the App contains the face of a third party, you are solely responsible for complying with applicable privacy laws and rights (including rights of likeness/portrait) with respect to the use, storage, and sharing of that photo. We have no involvement in, and bear no responsibility for, the content of photos you select.
To the maximum extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, or consequential damages arising from use of the App, except in cases of willful misconduct or gross negligence. Nothing in these Terms limits liability that cannot be limited by law, including statutory consumer rights.
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or detection accuracy, to the extent permitted by law.
We may modify, update, or discontinue the App at any time with or without notice.
We may revise these Terms. Continued use after changes constitutes acceptance.
For consumers residing in the EU/EEA and the United Kingdom, mandatory consumer-protection provisions (including Directive 2011/83/EU as implemented) prevail over conflicting provisions of these Terms.
These Terms are governed by the laws of Japan. Exclusive jurisdiction for disputes lies with the Tokyo District Court as the court of first instance, without prejudice to mandatory consumer-forum rules in your country of residence.

본 앱은 기본적으로 무료로 이용할 수 있으며 광고 표시 및 이용 횟수 제한이 있습니다. 광고 제거 및 이용 제한 해제를 위한 1회성 인앱 구매를 제공합니다. 가격은 Apple App Store의 본 앱 스토어 페이지에 표시되는 가격이 정식 가격입니다. 구매, 결제, 환불에 대해서는 Apple App Store의 약관 및 정책이 적용됩니다. 당사는 원칙적으로 직접 환불을 진행하지 않습니다.
본 앱의 UI, 코드, 디자인, 상표 및 기타 모든 콘텐츠에 관한 저작권 및 지적재산권은 당사 또는 정당한 권리자에게 귀속됩니다. 사용자는 사적 이용 범위 내에서만 본 앱을 이용할 수 있는 제한적이고 양도 불가능한 라이선스를 부여받습니다. 사용자가 본 앱을 이용하여 만든 얼굴 앨범(콜라주 이미지) 자체의 이용은 사용자 본인의 사진 소재에 대한 권리 범위 내에서 사용자 본인의 책임하에 이루어집니다.
사용자는 다음 행위를 해서는 안 됩니다.
본 앱의 얼굴 감지 및 인물 검색 기능은 Apple의 Vision 프레임워크 및 온디바이스 머신러닝 모델을 이용한 자동 처리로서, 항상 정확한 결과를 보장하지 않습니다. 사진의 화질, 각도, 조명, 가림 등에 따라 얼굴 미검출, 오검출, 인물 혼동이 발생할 수 있습니다.
본 앱은 의료, 법 집행, 신원 확인, 인증(잠금 해제 등 보안 용도)을 목적으로 하지 않으며, 이러한 용도로 사용하는 것을 상정하지 않습니다. 본인 확인 등 중요한 판단을 본 앱의 결과에만 의존하지 마십시오.
사용자가 본 앱에서 처리하는 사진에 제3자의 얼굴이 포함된 경우, 해당 사진의 이용·보관·공유에 관해 적용되는 프라이버시 관련 법령(초상권 포함)을 준수할 책임은 사용자 본인에게 있습니다. 당사는 사용자가 선택한 사진의 내용에 일절 관여하지 않으며 책임을 지지 않습니다.
당사는 본 앱의 이용으로 발생한 직접적·간접적·부수적·결과적 손해에 대해, 당사에 고의 또는 중대한 과실이 있는 경우를 제외하고 일체의 책임을 지지 않습니다. 다만 법령상 면책이 인정되지 않는 범위에서는 그러하지 아니하며, 당사의 책임은 적용 법률이 허용하는 최대 한도에서 제한됩니다. 소비자계약법 기타 강행법규에 따라 사용자에게 인정되는 권리는 본 조에 의해 제한되지 않습니다.
본 앱은 "있는 그대로" 제공되며, 상품성, 특정 목적 적합성, 비침해성, 감지 정확도 등에 관하여 명시적 또는 묵시적 보증을 하지 않습니다.
당사는 사전 통지 유무와 관계없이 본 앱의 내용 변경, 업데이트, 배포 중단을 할 수 있습니다.
당사는 본 약관을 개정할 수 있습니다. 중요한 변경 사항은 앱 내 또는 스토어 페이지에서 공지합니다. 개정 후 본 앱을 계속 이용하는 경우 변경에 동의한 것으로 간주됩니다.
EU/영국 거주 소비자에 대해서는 소비자 보호에 관한 강행법규(지침 2011/83/EU 등)가 본 약관에 우선하여 적용됩니다.

本应用基本免费使用，含广告展示及使用次数限制。我们提供一次性应用内购买以移除广告并解除使用限制。价格以 Apple App Store 上本应用商店页面显示的价格为准。购买、付款及退款事宜适用 Apple App Store 的条款及政策。我们原则上不直接办理退款。
本应用的用户界面、代码、设计、商标及其他一切内容的著作权及知识产权归我们或合法权利人所有。用户获得的是仅限于个人非商业用途的、有限的、不可转让的许可。用户使用本应用制作的人脸相册（拼贴图像）本身的使用，须在用户对其原始照片素材所享有权利的范围内，由用户自行负责。
用户不得进行以下行为：
本应用的人脸检测与人物搜索功能依赖 Apple 的 Vision 框架及设备端机器学习模型进行自动处理，不保证始终提供准确的结果。根据照片质量、角度、光线及遮挡情况，可能出现漏检、误检或人物混淆的情况。
本应用不适用于医疗、执法、身份验证或认证（如设备/账户解锁等安全用途）目的，也不应用于此类用途。请勿仅依据本应用的结果作出需要确认身份的重要决定。
如果用户在本应用中处理的照片包含第三方的面部，用户应自行负责遵守适用的隐私相关法律法规（包括肖像权），并对该照片的使用、保存及分享承担责任。我们不参与用户所选照片的内容，亦不承担任何责任。
在适用法律允许的最大范围内，除我们存在故意或重大过失外，我们对因使用本应用而产生的任何直接、间接、附带或后果性损害不承担责任。但法律不允许免责的范围除外，我们的责任在适用法律允许的最大限度内予以限制。本条不限制消费者依据消费者合同法等强制性法律规定所享有的权利。

Estos Términos rigen su uso de la aplicación móvil "PickFace" (la "App") proporcionada por un desarrollador individual ("nosotros").
La App detecta y recorta rostros de una foto grupal que usted seleccione, los organiza en un adorable collage de "álbum de rostros" y puede buscar en la biblioteca de fotos de su dispositivo fotos que contengan a una persona elegida. Todo este procesamiento se realiza enteramente en su dispositivo; ninguna foto se transmite por la red.
La App es gratuita, con publicidad y límites de uso. Se ofrece una compra única dentro de la aplicación para eliminar anuncios y desbloquear los límites de uso. El precio que se muestra en la página de la App en la Apple App Store es el precio oficial. Las compras, la facturación y los reembolsos se rigen por los términos y políticas de la Apple App Store. Por regla general, no procesamos reembolsos directamente.
Todos los derechos de autor, marcas, diseño, código e interfaz de usuario de la App nos pertenecen a nosotros o a nuestros licenciantes. Se le concede una licencia limitada, intransferible y revocable para usar la App con fines personales y no comerciales. Las funciones de detección facial y búsqueda de personas de la App se basan en procesamiento automatizado en el dispositivo utilizando el framework Vision de Apple y modelos de aprendizaje automático en el dispositivo, y no garantizan resultados precisos en todo momento. Dependiendo de la calidad de la foto, el ángulo, la iluminación y las obstrucciones, la App puede no detectar rostros, producir detecciones falsas o confundir a una persona con otra.
La App no está destinada a fines médicos, de aplicación de la ley, de verificación de identidad o de autenticación (como desbloquear dispositivos o cuentas) y no debe usarse para dichos fines. No confíe únicamente en el resultado de la App para ninguna decisión que requiera la identificación confirmada de una persona.
Si una foto que procesa en la App contiene el rostro de un tercero, usted es el único responsable de cumplir con las leyes y derechos de privacidad aplicables (incluidos los derechos de imagen) respecto al uso, almacenamiento y compartición de dicha foto. La App se proporciona "TAL CUAL" y "SEGÚN DISPONIBILIDAD" sin garantías de ningún tipo, expresas o implícitas, incluidas la comerciabilidad, la idoneidad para un propósito particular, la no infracción o la precisión de detección, en la medida permitida por la ley.

Les présentes Conditions régissent votre utilisation de l'application mobile « PickFace » (l'« Application ») fournie par un développeur individuel (« nous »).
L'Application détecte et recadre les visages d'une photo de groupe que vous sélectionnez, les organise en un adorable collage « album de visages », et peut rechercher dans la photothèque de votre appareil des photos contenant une personne choisie. Tout ce traitement s'effectue entièrement sur votre appareil ; aucune photo n'est transmise sur le réseau.
L'Application est gratuite, avec publicité et limites d'utilisation. Un achat intégré unique est proposé pour supprimer les publicités et lever les limites d'utilisation. Le prix affiché sur la page de l'Application sur l'Apple App Store fait foi. Les achats, la facturation et les remboursements sont régis par les conditions et politiques de l'Apple App Store. En principe, nous ne traitons pas les remboursements directement.
Tous les droits d'auteur, marques, design, code et interface utilisateur de l'Application nous appartiennent ou appartiennent à nos concédants. Diese Bedingungen regeln Ihre Nutzung der mobilen Anwendung „PickFace" (die „App"), die von einem Einzelentwickler („wir") bereitgestellt wird.
Die App erkennt und schneidet Gesichter aus einem von Ihnen ausgewählten Gruppenfoto zu, ordnet sie zu einer niedlichen „Gesichtsalbum"-Collage an und kann in der Fotobibliothek Ihres Geräts nach Fotos einer ausgewählten Person suchen. Die gesamte Verarbeitung erfolgt vollständig auf Ihrem Gerät; es werden keine Fotos über das Netzwerk übertragen.
Die App ist kostenlos nutzbar, mit Werbung und Nutzungsbeschränkungen. Es wird ein einmaliger In-App-Kauf angeboten, um Werbung zu entfernen und Nutzungsbeschränkungen aufzuheben. Der auf der Store-Seite der App im Apple App Store angezeigte Preis ist maßgeblich. Käufe, Abrechnung und Rückerstattungen unterliegen den Bedingungen und Richtlinien des Apple App Store. Wir wickeln grundsätzlich keine direkten Rückerstattungen ab.
Alle Urheberrechte, Marken, das Design, der Code und die Benutzeroberfläche der App gehören uns oder unseren Lizenzgebern. Ihnen wird eine beschränkte, nicht übertragbare, widerrufliche Lizenz zur Nutzung der App für persönliche, nichtkommerzielle Zwecke gewährt. Jedes von Ihnen mit der App erstellte Gesichtsalbum (Collage) ist Ihre eigene Schöpfung aus Ihrem eigenen Fotomaterial, und dessen Nutzung unterliegt Ihren eigenen Rechten an den zugrunde liegenden Bildern und Ihrer eigenen Verantwortung.
Sie dürfen nicht: (a) die App zurückentwickeln, dekompilieren oder disassemblieren, einschließlich der Extraktion eines auf dem Gerät befindlichen Modells; (b) die App vervielfältigen, weiterverbreiten, vermieten oder verkaufen; (c) die App mit Fotos Dritter ohne deren Zustimmung zum Zweck der Identitätstäuschung, Belästigung, Verleumdung, Verfolgung oder einer anderen Verletzung der Rechte einer anderen Person verwenden; (d) geltende Gesetze verletzen; oder (e) die Funktionsfähigkeit der App beeinträchtigen.
Die Funktionen zur Gesichtserkennung und Personensuche der App beruhen auf automatisierter Verarbeitung auf dem Gerät unter Verwendung des Vision-Frameworks von Apple und Machine-Learning-Modellen auf dem Gerät und garantieren keine jederzeit genauen Ergebnisse. Je nach Fotoqualität, Blickwinkel, Beleuchtung und Verdeckungen kann die App Gesichter nicht erkennen, Fehlerkennungen erzeugen oder Personen verwechseln.
Die App ist nicht für medizinische Zwecke, Strafverfolgung, Identitätsprüfung oder Authentifizierung (wie das Entsperren von Geräten oder Konten) bestimmt und sollte nicht für solche Zwecke verwendet werden. Verlassen Sie sich für Entscheidungen, die eine bestätigte Identifizierung einer Person erfordern, nicht ausschließlich auf die Ausgabe der App.
Enthält ein von Ihnen in der App verarbeitetes Foto das Gesicht eines Dritten, sind Sie allein dafür verantwortlich, die geltenden Datenschutzgesetze und Rechte (einschließlich des Rechts am eigenen Bild) hinsichtlich Nutzung, Speicherung und Weitergabe dieses Fotos einzuhalten. Wir sind an den Inhalten der von Ihnen ausgewählten Fotos in keiner Weise beteiligt und übernehmen dafür keine Verantwortung.
Soweit gesetzlich zulässig, haften wir nicht für direkte, indirekte, zufällige oder Folgeschäden, die aus der Nutzung der App entstehen, außer bei Vorsatz oder grober Fahrlässigkeit. Nichts in diesen Bedingungen beschränkt eine Haftung, die gesetzlich nicht beschränkt werden kann, einschließlich gesetzlicher Verbraucherrechte.
Die App wird „WIE BESEHEN" und „WIE VERFÜGBAR" ohne Gewährleistung jeglicher Art bereitgestellt, weder ausdrücklich noch stillschweigend, einschließlich Marktgängigkeit, Eignung für einen bestimmten Zweck, Nichtverletzung von Rechten Dritter oder Erkennungsgenauigkeit, soweit gesetzlich zulässig.
Wir können die App jederzeit mit oder ohne vorherige Ankündigung ändern, aktualisieren oder einstellen.
Wir können diese Bedingungen überarbeiten. Die fortgesetzte Nutzung nach Änderungen gilt als Zustimmung.
Für Verbraucher mit Wohnsitz in der EU/im EWR und im Vereinigten Königreich haben zwingende verbraucherschützende Bestimmungen (einschließlich der umgesetzten Richtlinie 2011/83/EU) Vorrang vor widersprüchlichen Bestimmungen dieser Bedingungen.
Diese Bedingungen unterliegen dem Recht Japans. Ausschließlicher Gerichtsstand für Streitigkeiten ist das Bezirksgericht Tokio als Gericht erster Instanz, unbeschadet zwingender Verbrauchergerichtsstandsregeln in Ihrem Wohnsitzland.
